The MyCITROËN  App application (the “Application”) is published by Automobiles Citroën (the “Manufacturer”), a limited company registered at the Versailles Trade and Companies Register under number 642 050 199 010 48 and whose headquarters are located at 2-10 boulevard de l'Europe, 78300 Poissy.

The Application is available to download from Google Play and Apple’s App Store. If you start downloading this Application, then you agree that once the Application has downloaded, you will not have a right to change your mind to cancel the contract. However, as mentioned in Section 9 below, you may stop using the Application and end your contract with us at any time.

We agree to make the Application available to you, provided that you accept these terms and conditions (we refer to such terms and conditions in the App Licence as the ‘App Licence’).

It is important that you read the App Licence carefully before you agree to it. The App Licence tells you who we are, how we may change or end the contract, what to do if there is a problem and other important information. As soon as you agree to the App Licence, that will form a contract between you and us.

You should print a copy of this App Licence for your records and future reference.

2 – TERMS & CONDITIONS OF USE

1° PREAMBLE 

The Application is a free mobile application, compatible with iOS 12 or higher and Android 7 or higher, designed for the Users’ personal information.

Access to and use of the Application are subject to the terms and conditions of use detailed below (the “Terms and Conditions of Use”) as well as all applicable laws and/or regulations. By connecting and accessing the Application, the User accepts the Terms and Conditions of Use.

2° ACCESS TO THE APPLICATION

The Application is accessible to individuals over the age of 18 (hereinafter referred to as “User(s)”), using a vehicle or not.

To use the Application, the User must have a compatible smartphone equipped with iOS 12 or higher or Android 7 or higher (the “Smartphone”).

If the User uses the Application while using a vehicle, the vehicle must be a MyCITROËN vehicle, suitably equipped with a compatible touchscreen (the “Vehicle”).

The Application can only be used if the User expressly accepts, when launching the Application for the first time, that the latest GPS position of the Vehicle be transferred to the applications installed on the Smartphone.

In order to make the most of the Application’s features, the User must create a personal account by completing the following mandatory fields: Title, First Name, Surname, Email and Password.

However, if the User has already opened an account on the MyCITROËN Website, the User shall not be required to open a new account for the Application. The User will be able to log into the Application using the same credentials as the ones used to log into the MyCITROËN Website.

The User’s identification code, password or any other piece of information are as confidential. The User must not disclose or transfer their $MyBrand accounts’credentials to any third party. All access using the password or email address shall be deemed to be made by the User under his own exclusive responsibility.The User’s credentials are exclusively intended to allow them to connect to $MyBrand Application and $MyBrand Website only.Therefore, the User cannot communicate their $MyBrand Account’s credentials to a third party in order to use the Services through another application and/or website.

The User must not make any use of the Services on any other website or networked computer environment without $CompanyName’s prior written consent.

If the User knows or suspects that anyone other than himself  knows his user identification code or password, the User must promptly notify $CompanyName.

$CompanyName  has the right to disable any user identification code or password or to suspend the User’s access to $MyBrand Application if the User has failed to comply with any of the provisions of the Terms and Conditions of Use and/or in case of suspicion of anormal activity and/or improper use of the User’s account.

Once their account has been activated, the User can access the Application’s content.

The User can, at any time from the user menu, unsubscribe from the MyCITROËN account. Unsubscribing leads to the deletion of the data stored in the Application. The contracts that the User has subscribed to, as well as the associated data, shall remain active.

In order to guarantee the features’ operation, the User shall ensure before starting the Vehicle that the Smartphone’s Bluetooth mode is enabled.

For Vehicles that are eligible, certain remote Vehicle control services (displayed in section 3 below) usable from a smartphone may require an association journey between the Vehicle and the personal account of the user. The details and conditions of this association course are available on . It is specified that the level of identification of the User for this association journey may vary depending the services.

3 ° INFORMATION RELATING TO THE APPLICATION’S CONTENT

The Application transfers information from the Vehicle to the User’s Smartphone to offer the following features:

3.1    For Smartphones compatible with iOS 12 or higher and Android 7 or higher:

Multi-vehicle: The User can save data (mileage, fuel consumption, next Vehicle service date, last known GPS position and/or address (if the Vehicle is equipped with a navigation system), driver’s final destination address) derived from the various Vehicles registered to the User’s account. The User can delete a Vehicle from their account.

Transferring the abovementioned data requires pairing the User’s Smartphone, via Bluetooth, to the Vehicle.

Vehicle Position: The Vehicle’s latest GPS coordinates, as well as the date and time the Vehicle’s position was recorded, are transferred to the Smartphone when the User turns the Vehicle’s ignition off, provided that the User’s Smartphone’s Bluetooth feature is enabled. If the User wishes to use the “Vehicle Position” feature,  their Vehicle’s GPS coordinates are transferred to the navigation application installed on their Smartphone that the User has chosen and that enables them to know, in Pedestrian mode, the exact location of their Vehicle when the feature is being used. The Vehicle’s position is instantly updated when the User refreshes their data. The action can lead to data charges. Depending on the terms of the contract signed by the User with their mobile telephone operator, additional charges may be incurred. The User must check with their mobile telephone operator.

The “Vehicle Position” feature can only operate if the Application is installed and launched, and if the Smartphone is connected in Bluetooth mode. Furthermore, this feature is only available if the Vehicle is equipped with a navigation touchscreen.

For vehicles not equipped with a touchscreen, the User can manually save the GPS position derived from their Smartphone in order to save the Vehicle’s position at end of the journey. To this end, the User must press the “Record my Position” feature of the Application.

For AMI/ Electric Vehicle, equipped with the DAT@AMI/ConnectBox connector unit, the Vehicle position is set using GPS coordinates of the Smartphone and sent to the Smartphone at the end of the journey. The User can also save the GPS position from his Smartphone himself.

Share my Location: The User can share their Smartphone’s GPS coordinates by clicking in the Application’s “Share my Location” section. The Application then lets the User choose the application on their Smartphone with which they want to share their GPS coordinates. The User can choose to send them via SMS, email or a message sent by the social media application installed on their Smartphone.

Prepare my route: The 'Prepare my route' feature allows the User to prepare their journey from the application and then send their destination to the touch screen of their Vehicle. The feature will only be visible if the Vehicle added in the application has a NAC Wave 3, NAC Wave 4 or AIO NAV Wave 2 touch screen. If the User wishes to use the 'Prepare my route' function, the Vehicle's GPS coordinates must first be entered by clicking on the button 'Position my vehicle'. When the GPS coordinates of the route are entered on the Smartphone and then sent, they will be displayed on the User's navigation system as soon as they pair their phone to the vehicle using bluetooth*.

*Sharing of data and vehicle location must be allowed in the touch screen settings.

In addition, “EV trip planner” is a feature of the Navigation Services as described in more detail below for eligible Battery Electric Vehicles (BEV) (where available) and will be included provided that the customer has subscribed to the Navigation Services concerned. Such Navigation Services include the following: NAVCO for NAV, IVIR1, IVIR2). “Prepare my Route EV trip planner is a feature with the following functionality: when a customer enters his desired destination and it is outside of the available electric vehicle battery range ,the EV Trip Planner feature will display a suggested route indicating where to stop and charge prior to the desired destination, and additional information about the journey. To do this the customer must enter the following information: destination, desired state of charge of the battery (SOC) at arrival, initial SOC of the battery at the start point, battery charging plug preferences. Depending on the privacy mode set on-board, the route start point will correspond with the customer’s actual location (as determined through the geolocation function of the Navigation Services). If the privacy mode on-board is set so that no geolocation information of the customer is shared, then this aspect of the feature will not work and the customer will have to input manually the start point for his desired destination. This service is provided through our third party supplier, TomTom and the information the customer supplies or if the privacy mode setting allows it, the geolocation data, is then shared with TomTom in order to provide this serviceh, . The EV trip planner part of Prepare my Trip will also have the followng functionality:

Save my destination: once the User's itinerary has been entered via the 'Prepare my route' function, they can  at any time save the GPS coordinates mentioned in the Application by clicking on the 'Save my destination' tab. The User can save up to 4 preferred destinations on their device.

Share my destination : once the User's itinerary has been entered via the 'Prepare my route' function, they will be able to share GPS coordinates of their destination by clicking on the 'Share my destination' tab.  The Application will then suggest selecting which application on the Smartphone they wish to share their GPS coordinates with. The User will then have the choice of sending them by SMS, email or by a message sent via the social network mobile application installed on their Smartphone.

Finish my Journey: The User destination’s GPS coordinates provided by their Vehicle’s navigation system are transferred to the Smartphone when the User turns off the ignition, providing their Smartphone’s Bluetooth feature is enabled. If the User wishes to use the “Finish my Journey” feature, their final destination GPS coordinates are transferred to the navigation application installed on their Smartphone that the User has chosen and that enables them to go to the location in Pedestrian mode. The action can lead to data charges. Depending on the terms of the contract signed by the User with their mobile telephone operator, additional charges may be incurred. The User must check with their mobile telephone operator.

The “Finish my Journey” feature can only operate if the Application is installed, launched and if the Smartphone is connected in Bluetooth mode. Furthermore, this feature is only available if the Vehicle is equipped with a navigation touchscreen.

 

Vehicle Alerts: The detection of anomalies relating to certain aspects of the Vehicle (such as fluid levels) is triggered once the journey is complete. These alerts concern the use and/or service of the Vehicle.

These alerts are for information purposes only. They do not exempt the User from:

 

Search for the Nearest Dealership: The User can look for the contact details of the nearest dealership by reference to their Smartphone’s GPS position. For this, the Smartphone’s GPS position is transferred to the Application. The User views on a map the dealerships around them and can save one as the “Preferred Dealership”. The User can also look for their dealership’s contact details by entering an address in the address search bar.

Furthermore, the User can, using the dealership’s contact form, send the dealership’s GPS coordinates to their Smartphone’s navigation application or call the dealership if the phone number is available.

The User can also filter their search results depending on the services offered by the dealership.

The User can also leave a comment and read the reviews and comments left by the dealership’s customers (refer to the terms on the MyCITROËN Advisor Website - https://www.citroen-advisor.co.uk/conditions).

Assistance provider: By clicking on the Application’s “Contact and Assistance” button, the User can trigger a call to the Manufacturer’s appointed roadside assistance provider’s number, if the User is eligible and/or has subscribed.

For AMI Electric Vehicle, by clicking on the “SOS” button in the Application, the User can initiate an emergency call via his Smartphone to the number 05 49348361. The call center, available 27/07 in your language from abroad, solicits the emergency services for the witnesses and the victims of a critical situation.

Brand contact: By clicking on the "Contact & Assistance" button from the Home tab, the User can navigate to the "Contact the brand" section to call customer service or submit an online request concerning any questions related to the brand. In order to better qualify questions, the User is able to add attachments, notably the application events log and/or journey data, if this service has been activated by the User.

MyCITROËN Assistance: By clicking on the Application’s “MyCITROËN Assistance” button, the User may obtain roadside assistance from the Manufacturer’s appointed provider of roadside assistance services (subject to subscription / eligibility – terms and conditions apply).

 

Appointment Booking (webview): By clicking on the Application’s “Make an Appointment” button, the User is redirected to a form that allows them to book an appointment at a Citroën dealership.

Making an appointment for AMI Electric Vehicle in a Euro Repar Car Services workshop: by clicking on the Application’s “Book an appointment” button, the User is redirected to the external Euro Repar Car Services website to request an appointment. Confirmation of the appointment request is sent by email to the User.

Quote (webview): By clicking on the Application’s “Contact & Quote” button, the User is redirected to a form that allows them to estimate the cost of a service (e.g., repair, maintenance) and to book an appointment with a Citroën dealership.

 

Video Tutorials: By clicking on the “Vehicle Documentation” button in the Vehicle section, the User can, depending on their Vehicle, access videos relating to the operation of their Vehicle by clicking on the “Video Tutorials” button.

 

Maintenance:

By clicking on the "Maintenance" tab of the Application, the User has the possibility of consulting an estimate of maintenance (date and mileage) and technical checks (date) of the Vehicle carried out or to come. The coming maintenance is estimated based on the start date of the Citroën manufacturer's warranty and the mileage of the Vehicle. The details of the interventions to be carried out for each maintenance and technical inspection are given for information only. The maintenance is based on the theoretical maintenance of the User's Vehicle and the technical inspection is based on a theoretical date (4 years for the first time then every 2 years). The User also has the option of declaring maintenance or technical inspections carried out, indicating mileage and a date. The User can also enter the cost relating to a declared maintenance or technical inspection and leave a comment on the service provided by the concessionaire. An indicative price may be displayed for the maintenance service according to what the concession offers. Depending on the elements that he has thus declared, a new estimate of maintenance and technical inspections (not declared) will be calculated. The User may at any time modify (date and mileage) or cancel his declaration.

 

When the User has subscribed to the E-book maintenance service:

By clicking on the "Maintenance" tab of the Application, the User can consult, in the "Maintenance to be done" section, the maintenance which must be carried out and in the "Performed maintenance" section, the maintenance carried out declared manually or declared by an authorized repairer or a repairer having the solution proposed by $ Brand linked to the E-book maintenance service. The User may at any time modify or delete the declaration he has entered manually, but he will not be able to modify or delete the declaration entered by a repairer.

For information on subscribing to the E-book maintenance service, the User should refer to the paragraph "E-book maintenance service" below.

 

Driving: The “Driving” tab appears if the Vehicle is eligible for connected services and transfers data relating to journeys carried out by the User’s Vehicle via Bluetooth or telephone network. The journeys record: the date with departure and arrival times, the duration, the fuel consumption (MPG), the distance covered, the average speed, the vehicle’s mileage and the cost of fuel if supplied by the User. The “Driving” tab allows the User to view the duration, distance, average consumption and cost of fuel (if previously supplied by the User) depending on all the selected journeys (per period). The User can view their driving data on a graph, filtered by date range.

If the User has a connected service with GPS comprising navigation, the details of the journey shall also contain the start and end location, as well as a map with the points of departure and arrival. The User can classify their journeys (work, pleasure, etc.). The User can create and add categories, enable or disable them and assign them for each journey. The User can view their journeys in a list and can filter them by date range. The User can view on the map the route between point A and point B at the end of their journey.

A notification is sent to the User each time a new journey, sent from the Vehicle connected in Bluetooth mode, appears in the Application, enabling them to confirm the transfer of driving data to the Application.

The table in the “Driving” tab allows the User to view the duration, distance, average consumption and cost of fuel (if supplied by the User) depending on all the selected journeys (per period and category). The User can view on the map the route between point A and point B at the end of their journey.

Journey data can sometimes be transferred by error when using Bluetooth connectivity. These journeys are displayed for information purposes only in the list of User journeys but they are not taken into account when calculating the statistics.

Merging Journeys: The User has the possibility to merge one or several journeys by selecting it/them in the list of journeys and clicking on the “Merging Journeys” icon. This feature allows the User to obtain a combined summary, once the journeys have been merged (for example, total distance covered for all the journeys).

Managing / Exporting Journeys: By clicking on the Application’s “Driving data” button, the User will be able to export their data to another compatible smartphone after installing the MyCITROËN application. In addition, the User can export their data in .csv file format.

News Section: By clicking on the Application’s “Latest News” button, the User can access the information relating to the MyCITROËN brand. If the User wishes to find out more, they can link to an external Website in order to view the article information in its entirety.

My Account: By clicking on the Application’s “My Account” button, the User can access and change the data relating to their account (First Name, Surname, Email, Telephone Number, and Address).

Offers: By clicking on the Application’s “My Offers” button, the User can access Citroën offers.

Recall campaign: From the "my account" page, the User can check whether his vehicle is affected by a Safety or Adjustment Campaign by clicking on "My recall campaigns". The presence of an uncompleted campaign assumes that the User quickly makes an appointment with an Authorized Repairer of the Brand to have his vehicle brought back into conformity. The costs relating to this retrofitting are borne by the Manufacturer.

Service Agreements: By clicking on the “Vehicle” tab and accessing the “Connected Services/Audio System” section, the User can view the contracts to which the User has subscribed, as well as the start and end dates. 

-Service Maintenance E-book : by clicking on the "Vehicle" tab and then on the "Services" button, the User displays the maintenance E-book service to which he can subscribe. The maintenance E-book service allows the User to view in the Application the details of his contract as well as the history of maintenance and repair operations that he has had carried out by an approved repairer or any other repairer, having the solution proposed by Citroen linked to this service.

To subscribe to the service, the User must first go to a dealer of the Brand who will activate it after having verified that the User is the owner of the Vehicle. After activation, the User can subscribe to the maintenance E-book service via the Application and thus access it. 

AMI Electric Vehicle: In the Application, the User can access the new specific features for AMI Vehicle on the home page:

For Android and iOS smartphones, compatible with Bluetooth 4.0 (Bluetooth Low Energy) or later version, the User will be able to upload the following AMI Vehicle information to the Smartphone via Bluetooth, using the DAT@AMI/ConnectBox connector unit:

The information will be reported at each connection to the Vehicle, at the start and at the end of the journey, and at the start of battery charge.

Bluetooth Connected services: by clicking on the on the “Vehicle” tab, then on the "Services" button of the Application, with an eligible Bluetooth service, you will be able to view the features of the Application which you will have access to by activating the Bluetooth services (journeys, alerts, etc.). If the User has subscribed to the Connect Pack service, he may also, after entering his security code, view the details of his connected service contract (start and end date of the contract and Vehicle data).

Navigation services: by clicking on the "vehicle" tab, then on the "Services" button, the user can see the navigation services to which he is eligible. The Application allows the User to access the SAMS platform to inquire and subscribe to a navigation service. If he has subscribed to it, he will be able to see the details of his contract, (date of beginning and end). The User also has the possibility, via SAMS, to subscribe to a complementary offer or renew his contract. Updating the Vehicle’s Touchscreen and Navigation Services: By clicking on the “Vehicle” tab then on the “Connected Services/Audio System” page, the User can view the navigation services to which they are subscribed. The Application allows the User to access the CITROËN Services Store in order to find out more and subscribe to a navigation service. The User can also, through the CITROËN Services Store, subscribe to an additional service or renew their current contract. The Application also updates the map service and/or the vehicle’s touchscreen software version if the User’s Vehicle, and their contract, allows this through the “Map service updates” and/or “Software update” pages.

Teleservices: By clicking on the Application’s “Vehicle” tab, then on “Services”, the User is able to see the any active subscriptions to the Telemaintenance service. The Application allows the user to access the CITROËN Services Store to find out more and activate their Teleservices subscription.

- Remote Controls: if the user has subscribed to this service, they will be able to use the following commands remotely (at any distance, as long as both the car and the smart device used by the user have a stable internet connection):

Buttons on the top section of the homepage activate the commands.

Users can check if the doors of their vehicle are locked or unlocked on the homepage.

- e-Remote Controls: owners of electric / hybrid vehicles who have subscribed to the e-Control Remote package (free of charge) will also be able to activate remotely the thermal preconditioning of their vehicle thanks to the dedicated button in the homepage. Tapping the button allows users  to:

The target temperature for the thermal preconditioning is 21°C.

Digital Service Record : by clicking on the "Vehicle" tab and then on the "Services" button, the User displays the Digital Service Record service to which he can subscribe. The Digital Service Record service allows the User to view in the Application the details of his contract as well as the history of maintenance and repair operations that he has had carried out by an approved repairer or any other repairer, having the solution proposed by $Brand linked to this service.

 

To subscribe to the service, the User must first go to a dealer of the Brand who will activate it after having verified that the User is the owner of the Vehicle. After activation, the User can subscribe to the Digital Service Record service via the Application and thus access it.

Electric vehicles: For electric vehicles eligible for the thermal preconditioning option, the User will be able to remotely adjust their heating or air conditioning and choose their intensity level from the "Battery and Air conditioning management" button on the home page. The User can also view the status of their battery.

Services for compatible electric and hybrid vehicles, provided thet the User has subscribed to the corresponding Service:

Remote E Control Service: the Application allows the User, from his smartphone, from the Home page, to:

The use of these functionalities is conditional on the activation of the service via the Application, requiring prior acceptance of the general conditions of use of the service (available at https://services-store.citroen.co.uk/store/e-remote-control and the successful completion of the association of the vehicle with the personal account of the User (details and conditions available at https://services-store.citroen.co.uk/sites/citroen/files/Pairing_Process_Terms_and_Conditions_AC.pdf

To subscribe to the service, the User must first go to a dealer of the Brand who will activate it after having verified that the User is the owner of the Vehicle. After activation, the User can subscribe to the maintenance E-book service via the Application and thus access it.  

Vehicle Documentation: By clicking on the Application’s “Vehicle Documentation” page, the User of an eligible Vehicle can access documentation relating to their Vehicle. Depending on the eligibility of your vehicle, you can potentially download a digital user guide availabkle at your fingertips. In the event of non-eligibility, you can still access a detailed description of the vehicle dashboard indicators.

Vehicle tutorials: By clicking on the 'Vehicle Documentation' page in the Vehicle section, the User can also, depending on their vehicle, access videos relating to the operation of their Vehicle by clicking on the 'Video Tutorials' button.

Bluetooth Services: By clicking on the Application’s “Bluetooth Services” button, the User eligible to the Bluetooth service can view the Application’s features to which they will have access by enabling the Bluetooth services (journeys, alerts, etc.).

Mobility Pass Service: The Mobility Pass service is a service provided by Credipar reserved for customers with a Peugeot/Citroen electric vehicle who have subscribed to the Mobility Pass option under an LOA, a finance lease or an LLD. It allows you to benefit from a Mobility Pass point account that can be used to rent a vehicle on the entire Free2Move Rent site, as well as a discount on the current rental price of Free2Move Rent Licensees.

If the VIN or the vehicle registered in My Citroen is that of an electric vehicle, the user email and the VIN of the vehicle are sent to Credipar via an electronic request in order to check whether the Mobility Pass option has been subscribed or not. If the Mobility Pass option has been purchased from Credipar, a 'Mobility Pass' button is displayed in the 'Vehicle' tan of the Application. By clicking on this button, the user sees the balance and expiry date of their Mobility Pass points account. A click on the 'Rent a Vehicle' button gives access to the Free2Move Rent site on which the Mobility Pass points credit can be used.

Application Notifications: Some of the applications's features can trigger notifications. The User will be notified if their Vehicle is due for a service within the next 30 days. A guage detecting a low fuel level for the Vehicle triggers a 'low fuel' notification. Finally, a 'fuel price update' notification allows the User to enter the price per litre of their fuel in order to monitor their spend. The User may disable notifications through the Application's settings in their profile.

 

Commercial notifications: The User may, at the time of installing the MyCITROËN App, elect to receive notifications promoting products and services that the Manufacturer believes may be of interest to the User. The User may then enable or disable promotional notifications through the Application’s settings in their profile at any time.

Selecting Units: The User will be able to change distance, cost and consumption units in the Application’s settings.

Choosing a Country/Language: The User will have a choice of countries/languages available for the Application if the language detected in their Smartphone’s settings does not allow the Application to choose a default language. The Users can select their county in order to benefit from a more personalised experience.

Third Party Applications: Access and use of third party applications are subject to terms and conditions of use that the User may have to read and accept when downloading them. Connection and access to these applications shall constitute acceptance by the User of the provisions of the terms and conditions of use. The Manufacturer is not liable for the content of third party applications.

3.2          For Android 4.1 Smartphones or higher version:

Some of these applications are technically compatible with the Mirror Screen feature (1). If the User wishes to download them, they must click on the application’s icon in order to be redirected to Google Play and download the application.

 (1) The “Mirror Screen” feature is available as standard or as an option depending on the Vehicle specification. The “Mirror Screen” feature enables the User to display on the Vehicle’s touchscreen some of the Smartphone’s applications, providing the Smartphone is compatible. Only MirrorLink™ certified applications will work (when the vehicle is stopped or moving, as the case may be). However, when driving, some of the features of the applications in question will be restricted. Certain types of content, accessible free of change on the Smartphone, require a paying subscription to a MirrorLink™ certified application. The Mirror Screen feature operates through the MirrorLink™ technology for telephones with Android, MirrorLink™ compatible, subject to the subscription of a telephone contract with Internet access with a provider. The Manufacturer is not liable for the Smartphone’s content, functionality or the software used in the “Mirror Screen” feature.

4 ° INTELLECTUAL PROPERTY RIGHTS

The Application is designed for consumer Users who are individuals. No commercial use of any kind of the data contained in the Application may be made without the Manufacturer’s prior written consent.

The Manufacturer and its suppliers remain the sole owners of all the intellectual rights relating to the Application.

The Manufacturer advises the Users that many of the Application’s elements:

are protected by the copyright legislation: this includes photos, articles, drawings, animated images, digital audio or video recordings; and/or are protected by the legislation on illustrations and models;

are protected by trademark legislation: this includes the “MyCITROËN” brands, the brand comprising the “Citroën” logo as well as the brand partners of the Manufacturer or content suppliers.

The elements thus protected are the property of the Manufacturer, its subsidiaries and/or third parties authorised by the Manufacturer to operate them. Consequently, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or in full, by any process, in any form or by any means and on any medium whatsoever of all or part of the Application is prohibited without the Manufacturer’s prior written consent, subject to the exceptions provided under applicable law.

The $Company and its relevant suppliers retain at any time ownership of all intellectual and industrial property rights, titles and interests with respect to $MyBrand App and related Applications for the provision of the Services. Any $MyBrand tools and related Application Programming Interface are the exclusive property of the $Company. Therefore, decompiling, disassembling, modifying, adapting or pentesting them is strictly forbidden without the prior written authorization of the $Company. The $Company may, in its sole discretion, provide such authorization and impose reasonable conditions on such use of the $MyBrand App and related Applications, or offer to provide alternatives to protect the $Company's proprietary rights therein. The User is responsible for any damages to the $Company or other $Company’s users that are caused by decompiling, disassembling, modifying, adapting and/or pentesting $MyBrand App and related Applications.  In no event may the User provide or disclose any information obtained pursuant to this Section to others or use such information in the development, production or marketing of a computer program or application substantially similar to the $MyBrand App and related Applications. No license or right is granted hereunder, whether express, by implication, or otherwise, with respect to any information obtained pursuant to this Section. The User shall not use or permit the use of the $MyBrand App and related Applications for any purpose other than the uses contemplated herein.

6° SAFETY

For safety reasons, it is recommended to use the Application when the Vehicle is stationary.

Information is collected when the Vehicle’s ignition is turned off.

The User agrees not to undertake actions likely to lead to viruses and computer or functional breakdowns or any other failure that could affect the operation of the Application or any server or any service accessible through the Application.

The use by the User of the Application and of any server or service accessible through the Application must conform to current legislations and regulations and must respect third party rights and shall not prejudice the Manufacturer's image, in any way or in any form whatsoever.

 

7° LIABILITY

The Manufacturer and its subsidiaries cannot be held liable for any direct or indirect damages, including material loss, loss of data or program, financial loss, resulting from the use of the Application or other applications installed on the User’s Smartphone.

The User is responsible for the use of the Application and shall assume full responsibility for the potential infringement of third party rights such as, but not limited to, any violation of freedom or privacy, which may result from the use of the Application by the User or other users of the Vehicle.

The Manufacturer shall not be held liable in the event of use contrary to current laws, improper use or fraudulent use by the User or any third party of the Application or the information received through the Application.

Likewise, the Manufacturer shall not be held liable in the event of a disruption of the communication networks that provide access to the Application, of total or partial unavailability of the Application resulting from the telecommunications operator, in the event of a transmission error or problems relating to the security of transmissions, in the event failure of the User’s Smartphone or telephone line.

The Manufacturer does not exclude or limit in any way its liability to the User where it would be unlawful to do so. Consequently, the Manufacturer does not exclude or limit liability for: death or personal injury caused by its negligence or the negligence of its employees, agents or subcontractors; fraud or fraudulent misrepresentation; or breach of the User’s legal rights in relation to the Application where such liability cannot be lawfully excluded or limited.

 

8° SUSPENSION OR INTERRUPTION OF ACCESS TO THE APPLICATION

The Manufacturer can suspend, at any time, temporarily or not, the User’s access to the Application in the event of: breach of the Terms and Conditions of Use by the User, without prejudice of any other rights and actions of the Manufacturer for technical problems relating to the infrastructure implemented for the Application’s operation or maintenance.

 

9° UPDATE OF THE TERMS AND CONDITIONS OF USE

The Manufacturer reserves the right to modify and/or update this Terms and Conditions of Use and can offer updates for the Application.

Access to updates may potentially be subject to the express acceptance of a new version of the Terms and Conditions of Use.

 

10° APPLICABLE LAW

 These Terms and Conditions of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England. Each party agrees that the courts of England shall have non-exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation. If the User lives in Scotland, then the User can bring legal proceedings in respect of the Application in the Scottish courts. If the User lives in Northern Ireland, the User can bring legal proceedings in respect of the Application in the Northern Irish courts.

Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without the User having to go to court. If the User is not happy with the way the Manufacturer has handled any complaint, the User may want to contact the alternative dispute resolution providers the Manufacturer uses.

The User can refer a dispute to Motor Codes Limited (“Motor Codes”). Further details can be found at www.themotorombudsman.org or alternatively the User may wish to contact their advice line on 0843 910 9000.  Where the dispute relates to any financial services, then the User can refer it to the Financial Ombudsman Service (“FOS”).  Further details can be found at www.financial-ombudsman.org.uk or if the User prefers to speak to someone they can call 0300 123 9123 or 0800 023 4567.  Neither Motor Codes nor the FOS will charge the User for referring a dispute (although the User may pay an additional amount for any call to them) and if the User is not satisfied with the outcome, the User can still bring legal proceedings.
